BIDDER’S INFORMATION - AUCTION INFORMATION & RULES
To bid in Paragon Auctions Internet/Phone auction you must register to receive a username and password. Click on Register/Sign In link on our homepage at www.paragonauctions.com. You may use this username and password for all future internet/phone auctions. Should you prefer telephone bidding, please call
(732) 261-9355 to obtain bidding information. Once you have obtained your username and password, log in each time you visit our site to browse, view, and bid. After you have completed the login procedure, the Register/Sign In button will switch to the My Account button, where you may view a status report of the items you are currently bidding on. Each lot has a minimum bid, which must be placed in order for the item to sell. Our minimum bids are the reserve prices and if met the item(s) will sell; All bids must be at least 10% above the current high bid showing. You may enter any bid amount you wish (rounded to the nearest dollar) as long it is at least 10% above the current high bid. The minimum bid is normally the reserve price, however, there will be some items with higher reserves that will show “reserve not met” once a bid is placed. Maximum/ceiling bids may be placed at any time and for any amount as long as they are at least 10% above the current bid. A ceiling bid only has to be 10% above the current high bid showing in order to be accepted and executed. All ceiling bids are entered into the auction computer database and are confidential. They are bid in increments by the auction software with the intention of securing the item at the lowest possible price up to and not exceeding the ceiling amount. Bid in our auction with confidence and confidentiality. Our auction software does not permit us the ability to see your proxy/ceiling bids during live bidding.
Initial bidding ends December 10th at 10 pm E.S.T., with bidding continuing for 15-minute intervals on an auction basis. Each time a bid is placed after 10 pm, the clock on the auction will be extended for 15 minutes. As a result, all lots will close at the same time if no bid is received for 15 minutes. The auction should not continue past 4 am Eastern Standard Time, but ParagonAuctions.com LLC has the right to extend the auction for any reason. You must bid on at least one item in the auction to continue bidding past 10 pm. As long as you have placed a bid on any individual lot, you are eligible to bid on ANY lot in the auction until the auction close. ParagonAuctions.com LLC reserves the right to reschedule or postpone any auction for any reason without recourse from any bidder or prospective bidder.

As we approach the initial bidding phase, at approximately 9 pm E.S.T. on December 10th, any lot with "reserve not met" will have the minimum bid moved up to the reserve, allowing for the next bid to be the current winning/high bid on the lot.

Telephone bidding will be available during both the auction and the extending bidding period. When outbid, an email will be sent notifying you of your status. Please make sure we have your correct email address in our system, you may check this on our website. When the auction ends, the winning bidder will be notified via e-mail. Internet and phone bids will be executed as a convenience to customers, but Paragon will not be held responsible for any failures, errors or omissions in the execution of such bids. All bids must be submitted within the guidelines of this auction. ParagonAuctions.com LLC reserves the right to accept or reject any and all bids by any bidder. ParagonAuctions.com LLC has the right to rescind any sale at our discretion without any recourse by any bidder or prospective bidder.
All sales are final on items authenticated by PSA/DNA bats and JSA autographs. All autographed items will come with a JSA auction letter unless noted. Some signed items will come with both JSA and PSA/DNA letters on autographs so you will get both letter’s as these were items submitted with a PSA/DNA letter when consigned for game used equipment (Other than Bats) there will be a 30 day return policy after the close of the auction on December 10th, 2016. Paragon Auctions LLC will have the final say on any item(s) in question. We will not accept a return based on a verbal opinion but will need a third party authenticator stating in writing why the item in question is not actually authentic. There will be no returns after 30 days for any reason. We use PSA/DNA for bats and JSA Authentication for autographs. Jerseys and equipment are done in house. There are no returns on graded cards, bats or autographs. Any trading card or card related item that is not graded will be viewable on our website and additional images may be provided upon request or you are welcome to view items in person. Jerseys and Equipment other than bats have a 30 day return policy. ParagonAuctions.com LLC travels to bring you some of the freshest items available during this process we will sometimes be the consignor of such items in the auction. There will be no returns after 30 days after the close of the auction on December 10, 2016.
All claims, disputes or controversies in connection with and or relating to and/or arising out of your participation in ParagonAuctions.com LLC (whether as a consignor, bidder or otherwise) including any purchaser of any item, any description of an item, any damage to an item whether asserted in contract, tort, or under any Federal or State statute or regulation shall be exclusively heard and decided by arbitration conducted by and under the rules of the American Arbitration Association. The location for all such arbitrations shall be in Middlesex County, New Jersey and the parties to this agreement mutually agree to waive the right to sue in any court and proceed with arbitration as the sole remedy. Both parties will be responsible for their own legal fees.
The respective rights and obligations of the parties with respect to the Rules and Conditions of Sale any disputes with this auction/agreement shall be settled by arbitration in Middlesex County in the state of New Jersey, and the parties to this auction/agreement mutually agree to waive the right to sue in any court and proceed with arbitration as the sole remedy. By bidding at an auction, whether by internet, telephone, present or by agent, the buyer shall be deemed to have consented to any disputes with this auction/agreement shall be settled by arbitration in the state of New Jersey, and the parties to this auction/agreement mutually agree to waive the right to sue in any court and proceed with arbitration as the sole remedy.
Placement of a bid in this auction constitutes acceptance of these terms and conditions. Auction Results will be available on our site at ParagonAuction.com following the close of the Auction. We will be glad to mail results to anyone upon request to any one sending in a self-addressed envelope. Some lots will have a hidden reserve, and will not sell until the bid has met this reserve. Consignor and/or “shill” bidding are strictly prohibited. Shill bidding is any bid(s) placed by a person or persons to drive up the final price paid and realized without intent to actually take ownership of the lot. Please note that it is a violation of law to make bids in a false name or with an invalid payment method, even if our software initially accepts such a bid. Fraudulent bidders will be prosecuted to the fullest extent of the law. Our Consignors will be blocked from bidding on their own item(s).
INVOICING & PAYMENT
All invoices will be sent via email on Monday, December 12th, 2016. Payment is due within 15 days of receipt of this invoice. Shipping and insurance charges are the responsibility of the buyer and will be listed on the invoice. THERE IS A 15% ADDITIONAL BUYERS PREMIUM (i.e. if you win with a bid of $1000 you will owe $1,150 (plus any applicable sales tax, shipping and handling fees.) Payment may be made by cash, traveler’s checks, money orders, wire transfers, and personal checks. No credit cards accepted. Personal checks will be held for a minimum of 10 business days before merchandise is shipped. Should legal action be required to collect unpaid balances, the bidder will be responsible for reasonable attorney’s fees and related court costs. In addition, Paragon Auctions reserves the right to re-sell any merchandise with an unpaid balance after 15 days with the bidder responsible for any losses incurred. ParagonAuctions.com, LLC reserves the right to charge interest on past due unpaid balances at 1.5% per month until paid in full.
Please be aware of shipping costs, especially for heavy, large, or large quantity lots. Any items with a dimension of 18” or greater will be subject to oversize charges by Fed Ex Ground. At the bidder’s request, we are willing to remove items from frames in order to save on shipping costs. Paragon Auctions is not responsible for frames or casing that may become damaged in transit. If you intend to pick up your items, please notify us one week prior to arrival. We ship via Fed Ex Ground 10 days after payment is received. Paragon Auctions will not ship to P.O. Boxes for any client. Please allow additional processing time for heavy, large, or large quantity orders. Paragon Auctions.com, LLC is not responsible for customs, duties, brokerage and/or similar charges on items shipped internationally. Shipments to Canada will no longer be done by Fed Ex Ground. Shipping of all items will be shipped Fed Ex Ground. You can request via FedEx Overnight or UPS Overnight Service which is available for any additional fees depending on items weight/size. ParagonAuctions.com, LLC will no longer ship to PO Boxes for any client. Framed items may get damaged in transit/handling and we will not be responsible for damaged frames. Framed items are NON-returnable due to frame damage.

ParagonAuctions.com, LLC guarantees the authenticity of each item in this auction only to the extent of the written catalog description. The description guarantee, however, does not extend to the condition grading of any item due to the subjective nature of such evaluations. Paragon Auctions LLC will have final say on item in question. We will not accept a return based on a verbal opinion but will need a third party authenticator in writing stating why the item in question is not factually authentic. We then reserve the right to consult with another respected third party authenticator to settle the dispute if necessary. Authenticity disputes must include the return of the disputed merchandise and must be executed within thirty-five (35) days from the date of the auction with no exceptions. Unless printed in the description, no LOA’s will be provided. Your invoice will be your LOA. Paragon Auctions reserves the right to withdraw any lot at any time prior to the auction and assumes no liability for such withdrawal. Paragon Auctions.com, LLC is not responsible for any errors whether typographical, photographic or technical, will be dealt with at our discretion. Our web site will always have the most updated descriptions on all items, as it can constantly be updated and is not limited to catalog space. While we do our best to accurately describe each lot, our web site provides additional photos that conveys the condition of said lot more suitably than any description possibly would. Please call with any questions you have on any lot. We are always available to answer questions.
Payment is due within 15 days from the date of the invoice. We accept Personal Checks, Cashier’s Check, Certified Checks and Money Orders which will all be held 10 business days. Wire Transfer funds will ship the next business day. We apologize for the hold but our bank recommends this. No Credit Card payments accepted. We have the right to charge interest at 1.5% for unpaid past due invoices.
New Jersey and South Carolina residents are responsible for taxes on winning bid(s).
